Sales contract

For a horse sold by Dolan Ranch. Fill every blank. Strike any sentence that does not apply and have both parties initial the strike.

2. Horse

   The Seller warrants that the Seller owns the horse and that the registered name and number above match the papers. Certification status today (certified / not yet certified): .

3. Price

   Purchase price: $ . Deposit: $ , applied to the price. Balance due before the horse leaves the ranch, by cashier's check or a transfer the Seller has confirmed. The deposit is refundable only if the Buyer completes the examination in the next section and gives written notice declining the horse within the time stated there. Otherwise the deposit is earned.

4. Examination

   The Buyer may have a veterinarian examine the horse at the ranch within days after the deposit. The Buyer pays the veterinarian. If the Buyer declines the horse in writing inside that window because of a finding in that examination, the Seller returns the deposit and neither party owes the other anything further on this sale.

   If the Buyer takes the horse without an examination, or the window passes without a written decline, the Buyer accepts the horse in its present condition.

5. Condition

   Except for the title and identity warranty above, the horse is sold as it stands on the day it leaves the ranch. The Seller does not warrant gait, color genetics, future height, fertility, show record, temperament under a new rider, or that a young horse will later pass RMHA certification. Any statement of breed on the Dolan Ranch website is a reading of the public registry and can be checked there before signing.

6. Papers and health

   When the price is paid in full, the Seller signs the registry transfer the RMHA requires and gives the Buyer the current registration papers. The Seller provides a negative Coggins test dated within twelve months. Vaccination and deworming dates the Seller can document: . Hauling off the ranch is the Buyer's responsibility and the Buyer's risk begins when the horse steps onto the Buyer's trailer, or onto a commercial van the Buyer hired.

7. Risk before pickup

   Until pickup, the Seller keeps the horse with ordinary care and is not an insurer. The Buyer may insure the horse from the day the deposit is paid. If the horse dies or is injured badly enough that it should not be sold, before the Buyer picks it up and without the Buyer's fault, the Seller returns the deposit and this contract ends.

8. Default

   If the Buyer does not pay the balance and pick up the horse within days after the examination window, the Seller may keep the deposit and sell the horse to someone else. If the Seller cannot deliver the papers and the horse, the Buyer receives the deposit back.

9. Law

   Florida law governs this contract. The parties consent to the state courts of Sumter County, Florida.
