The mare must be approved by the Stallion Owner in writing before breeding. Approval can be refused for any reason, including breed, size, gait, temperament, or health.

Non-silver rule
Toby's Samson is tested homozygous silver, EE Aa ZZ. The RMHA stud listing prints Zz, and that printing is an error. Because he is ZZ, every foal inherits silver from him. He is bred only to mares that are not silver and are not known to carry silver, so the foal is Zz and not ZZ. The Mare Owner warrants that the mare does not show silver and, to the owner's knowledge, does not carry it. A chestnut or other horse whose color can hide silver needs a negative silver test from a recognized laboratory, attached to this contract, unless the Stallion Owner waives that test in writing. Breeding that would risk a homozygous silver foal will not be accepted. If the warranty in this section is false, the service fee is earned and no rebreed or refund is owed.

Service

The published service fee is eight hundred fifty dollars ($850). The fee on this signed page controls if it differs: $ . A booking deposit of $ is due when this contract is signed and is credited toward the service fee. The balance is due before the mare leaves the ranch, or before frozen semen is released for shipment.
Frozen semen shipping, tank rental, and storage charges are billed to the Mare Owner on top of the service fee. The Stallion Owner does not insure shipped semen unless a separate written term says so.

Mare care
Mare care is available. Board is $ per day from the day the mare arrives until the day she leaves. Veterinary, farrier, and extra-feed bills are passed through at cost. The Mare Owner pays those bills before the mare leaves. We may refuse a mare that arrives without a negative Coggins test dated within twelve months, or without the health papers Florida requires for the trip.

What is not promised
There is no live-foal guarantee unless the Stallion Owner initials this sentence: ________. There is no free return service unless the Stallion Owner initials this sentence: ________. Color, gait, height, temperament, and certification of a foal are not warranted. The stallion's RMHA certification and the breeding dates will be stated honestly. A breeder's certificate or the registry signature needed to register the foal will be provided when the service fee, board, and passed-through bills are paid in full.

Risk
From arrival until departure, the Mare Owner retains ownership of the mare and of any foal at her side. The Stallion Owner will use ordinary care. The Stallion Owner is not an insurer of the mare. Each party is responsible for its own negligence. The Mare Owner carries mortality insurance if the Mare Owner wants that protection.

Law
Florida law governs this contract. The parties consent to the state courts of Sumter County, Florida. If a court removes one sentence, the rest of the contract remains.
